General terms of use of the tucoworking platform

1. What tucoworking is and what it is not
tucoworking is a workspace marketplace operated by FUSTIBUS S.COOP GALEGA (ESF44660918). Its role is to publish the offering of coworking operators and to allow users to search it, book it and, where applicable, pay for it online.
tucoworking does not provide the coworking service. The service is provided by the operator of the venue, who assumes the obligations relating to access, use, safety, maintenance and on-site assistance. By booking, the user enters into a contract with that operator; tucoworking acts as an intermediary and as a payment platform.
2. User account
An account is required in order to book. Users must be at least 18 years old, have legal capacity to contract, and provide accurate, up-to-date information. Credentials are personal: the account holder is responsible for the activity carried out with them and must immediately report any unauthorised use to info@tucoworking.com.
Users may close their account at any time from their personal area. Closing the account does not affect bookings already confirmed or the obligation to retain tax and accounting records.
3. Publication of listings and ranking of results
Venue listings are maintained by the operators. tucoworking reviews new listings before publishing them, but does not continuously verify every data point.
The order of search results depends on the sorting criteria chosen by the user (relevance, price or distance). "Relevance" is influenced by the match with the search, proximity, the actual availability of the unit and the quality of the listing. The commission paid by the operator does not affect the position in the results and tucoworking does not accept payments to improve organic ranking.
4. Bookings and payments
Prices, the booking process and payment conditions are set out in the Contracting terms and in the Pricing and payments policy. Cancellations and refunds are governed by the Cancellation and refund policy.
In addition to these terms, each service has its own particular conditions (flexible desk, private office, meeting room, event space or monthly contracting), which are displayed and accepted at the time of booking or contracting.
5. Invoicing
The invoice for the service is always issued by the operator, not by tucoworking. Where payment is made online, tucoworking issues a payment receipt, which is a receipt with no tax effect. If the customer needs an invoice, they may request it from their booking details and tucoworking will forward the request and their tax details to the operator.
6. User conduct
Use of the platform and of the spaces is subject to the Acceptable use policy. Serious or repeated breaches allow tucoworking to suspend or close the account, stating the reason and the available complaint channels.
7. Liability
tucoworking is responsible for the operation of the platform, for the correctness of the amount charged and for processing any applicable refunds. It is not responsible for the actual provision of the service at the venue, the condition of the premises, the behaviour of other users or the belongings the customer brings to the space; those responsibilities lie with the operator under applicable law.
None of the above limits the rights that consumer protection legislation grants to users acting as consumers on a mandatory basis.
8. Data protection
The processing of personal data is described in the Privacy policy. In order to complete a booking, tucoworking discloses to the operator the data strictly required to provide the service.
9. Changes to these terms
tucoworking may amend these terms for regulatory, technical or service-related reasons. Amendments are communicated with reasonable notice through the platform or by email and do not affect bookings already confirmed, which remain governed by the terms in force when they were made.
10. Applicable law and complaints
These terms are governed by Spanish law. Complaint and out-of-court settlement channels are described in the Dispute resolution document.
